Forms
Beside the contract, there are other forms related to the project
which may come into play. Below is a brief description followed
by a link to view examples of any of the forms.
- 3-Day Notice of Cancellation - unless this purchase
was made at the contractor’s place of business,
federal law mandates the consumer has three business days in
which to rescind the contract in writing. This form should be
attached to all such contracts.
- Notice of Excusable Delay and Request for Extension of
Time - a necessary form to execute in order to legally change
the time to complete the project.
- Change Order - every single change made in the project
which may affect the price, the date of completion or
any other aspect of the contract, must be specified in writing
and signed by the buyer.
- Extra Work Order - approval, in writing, by the
responsible party, for additional or necessary work to complete
the project, not originally included in the agreement
.
- Notice of Completion - legal document to county
recorder establishing that the work has been completed to
contractee’s satisfaction.
- Preliminary Notice - those who provide material,
equipment,or services for use in the project, must use this
form to notify the buyer that if the contractor fails to pay,
they have a legal right to come after the buyer for payment.
Even if the buyer has paid the contractor but
the contractor has not paid the supplier, the supplier comes
after the property owner. The Preliminary Notice is advance
notice, that if the supplier is not paid by the contractor, the
supplier will file a Mechanic’s Lien against the property.
It then becomes the buyer’s responsibility to be sure the
contractor pays the supplier. This is done through the use of
Conditional and Unconditional Release notices.
- Mechanic's Lien - this is a legal document of
notification that a lien has been placed against the property for
nonpayment. This could be filed by the contractor against the
property owner for nonpayment or, against the property owner by a
supplier of material, equipment or services, due to nonpayment by
the contractor.
- Mechanic’s Lien Release - a legal
document of notification that the Mechanic’s Lien has been
satisfied.
- Conditional Waiver & Release Upon Progress Payment
- is used by a party who applies for a progress payment when the
progress payment check has not yet cleared the bank.
This release only becomes effective when the check has
cleared the bank.
- Unconditional Waiver & Release Upon Progress
Payment - waives rights unconditionally (for work performed
during a certain period) and states the contractor has been paid
for giving up those rights.
- Conditional Waiver & Release Upon Final Payment -
is used by a party who applies for a progress payment when the
progress payment check has not yet cleared the bank. This
release only becomes effective when the check has
cleared the bank.
- Unconditional Waiver & Release Upon Final Payment
- this document waives rights unconditionally and states that the
contractor, supplier of material or equipment has been paid and
gives-up rights to seek any further payment.
